TERMS AND CONDITIONS
ARTPLUSEXPLAINS, LLC
By making a travel reservation with ARTPLUSEXPLAINS, LLC ("Artplus" or "the Company"), you (the "Client") accept and acknowledge the terms and conditions ("T&C") set forth herein. The reservation is subject to the condition that Artplus satisfactorily receives the first payment, which will be confirmed to the email address provided. If said payment is not received, no binding agreement will be established between Artplus and the Client.

1. Payments and Reservation
The cost of the Trip, payment dates, and amounts are detailed in the confirmation document sent to the Client's email address. Charges will be made in euros (EUR) or in the currency specified in said document. If payment is made in a different currency, the exchange rate in effect at the time of payment, as determined by the chosen payment method, will apply. The Client may choose to pay the full amount in advance at any time.

2. Payment Policy, Default, and No Refund
2.1 No Refund. All payments made to Artplus are non-refundable, without exception, regardless of the reason for cancellation by the Client. This is due to irrevocable financial commitments made by Artplus to suppliers and third parties involved in the execution of the Trip.
2.2 Cancellation by the Client. If the Client cancels their participation after making the first reservation payment, they will forfeit the amount paid and will not be entitled to any refund.
2.3 Default on Payment Schedule. If the Client fails to make any scheduled payment within five (5) business days of the due date, Artplus reserves the right to release the Client's spot and offer it to another person, with no obligation to refund amounts already paid.
2.4 Cancellation by Artplus. In the event that Artplus cancels the Trip for reasons directly attributable to the Company and unrelated to force majeure, the Client will be entitled to a full refund of payments made, or may apply the balance as credit toward a future trip, at the Client's discretion. This is the sole exception to the no-refund policy.

3. Rescheduling, Acts of God, and Force Majeure
Artplus will not be obligated to refund payments received in the event of delay, cancellation, or rescheduling of the Trip caused by circumstances beyond its reasonable control, including without limitation: fire, explosion, flooding, adverse weather conditions, power failures, war, social, political or economic conflicts, acts of terrorism, strikes, road closures, epidemics, pandemics, or government restrictions.
In the event of rescheduling due to any of the above causes, payments made will be applied as full credit toward the new trip date, with no obligation of refund on the part of Artplus.

4. Transfer of Reservation
The reserved spot is personal and non-transferable, except with the express written authorization of Artplus. If the Client wishes to transfer their spot to a third party, they must submit a request at least thirty (30) calendar days before the Trip start date. Artplus reserves the right to approve or deny such request and may condition the transfer on the payment of an administrative fee.

5. External Suppliers
Artplus will work with local suppliers ("Suppliers") to carry out stages of the Trip, including accommodation, transportation, meals, and cultural services. Artplus has conducted reasonable due diligence regarding said Suppliers; however, the Client expressly releases Artplus from any liability arising from acts or omissions of Suppliers that result in damage or injury to the Client's person or belongings.

6. Risks, Health, and Insurance
6.1 Assumption of Risk. The Client acknowledges that the Trip may include physical activities and outings that carry inherent risks. In the event of an emergency, immediate medical attention may not be available or easily accessible.
6.2 Mandatory Travel Insurance. Artplus requires that each Client hold a valid international travel and medical insurance policy for the full duration of the Trip, covering accidents, illness, cancellations, lost luggage, and repatriation. Obtaining and funding said insurance is the Client's sole responsibility..
6.3 Physical Condition. The Client declares that they are in adequate physical and health condition to participate in the Trip, and will be solely and financially responsible for their own wellbeing throughout. Artplus, its employees, and representatives will not be liable for incidents causing damage, injury, or death to the Client, nor for damage, theft, or loss of their belongings or documents.

7. Travel Documentation and Requirements
The Client is solely and exclusively responsible for holding valid and current documentation required for the Trip, including passport, visas, entry authorizations, vaccinations, or other health requirements. Artplus does not handle immigration procedures and is not responsible for consequences arising from failure to meet these requirements, including inability to board or enter the country, without entitlement to any refund.

8. Admission and Participant Conduct
The Client declares they are of legal age at the time of reservation. Once the Trip has begun, Artplus has the right to determine, at its sole discretion, whether a Client's conduct jeopardizes the harmony, safety, or wellbeing of the group, and may remove said Client from the Trip without any refund obligation. This includes, without limitation: discriminatory acts or remarks, physical or verbal aggression, use of prohibited substances, intoxication, serious disrespect toward other participants or host communities, or violation of local laws and regulations.

9. Use of Images and Audiovisual Material
During the Trip and in any activity or gathering related to it, whether organized by Artplus or by third parties, including online sessions, video conferences, preparatory meetings, social events, and pre- or post-trip gatherings, Artplus and its team may take photographs, screenshots, and videos of participants. By confirming their reservation, the Client grants Artplus their express and irrevocable consent for such images and audiovisual materials to be used for promotional, educational, and marketing purposes, including the social media and digital platforms of @maitexplainsart and @artplusexplains, the website artplusexplains.com, and marketing materials in general. If the Client does not wish their image to be used for these purposes, they must notify Artplus in writing before the Trip begins.

10. Flights and Services Not Included
Unless expressly stated otherwise, Artplus does not manage and is not responsible for flights, transfers to the Trip's starting point, or any service outside the contracted package. Artplus will not be liable for cancellations or delays in flights or other independent means of transportation, nor for any expenses these may generate.

11. Personal Data
Personal data provided by the Client will be processed in accordance with the Privacy Policy of Artplusexplains, LLC, available at
https://www.artplusx.com/privacypolicy. The Client consents to their data being used for Trip management and for sending information about future trips and Artplus activities, with the option to unsubscribe at any time.
12. Governing Law and Jurisdiction
This document is governed by the laws of the State of Texas, United States of America. Any dispute will be resolved by the competent courts located in Houston, Texas, to whose jurisdiction the Client expressly submits.
